
UTECA responds to industry La Uni n de Televisiones Comerciales en Abierto (UTECA) env a una carta abierta al ministro Jos Manuel Soria.
Ante la resoluci n de la Secretaria de Estado de Telecomunicaciones y para la Sociedad de la Informaci n (SETSI) emitida la semana pasada en la que se requiere a los cuatro operadores nacionales de televisi n el cese de emisiones de nueve de los veinticuatro canales que actualmente emiten a trav s de la TDT, antes del 6 de mayo, la Uni n de Televisiones Comerciales en Abierto (UTECA) ha hecho p blica una carta abierta dirigida al ministro de Industria Jos Manuel Soria.
Para UTECA, el cese de emisiones de nueve canales de televisi n al que se nos est forzando supone una situaci n sin precedentes en cualquier democracia, un ataque a los derechos de los ciudadanos, que van a ver reducida su capacidad de elecci n y una significativa merma de los canales que ofreci la transici n de la televisi n anal gica a la digital, mayoritariamente gratuita .
Tambi n quieren hacer constar que m s all de esta preocupante reducci n de la pluralidad informativa y de ocio, el cierre de nueve canales implicar un impacto econ mico en toda la industria audiovisual espa ola. Productoras, creadores, artistas, proveedores tecnol gicos y otros muchos actores implicados en la cadena de valor del audiovisual se ver n afectados, y en muchos casos, gravemente. Un importante n mero de puestos de trabajo, directos e indirectos, se pondr n en riesgo con esta decisi n. A ello se suman los millones de euros invertidos para poner en marcha estos canales, y que, con su cierre forzoso, simplemente se perder n .
Pero en materia econ mica es a n m s lo que se est poniendo en riesgo. La inseguridad jur dica y la incertidumbre regulatoria que se desprenden de esta decisi n est n provocando la paralizaci n de futuras inversiones, y que empresas tanto nacionales como internacionales se cuestionen la idoneidad de instalarse en nuestro pa s y de invertir en nuestro sector audiovisual. Es posible que el descr dito al que se somete a la marca Espa a con el cierre de esos nueve canales de televisi n no haya sido adecuadamente valorado por su Ministerio cuando decidi emprender este camino , contin a la misiva al ministro.
Desde que en noviembre de 2012 el Tribunal Supremo dict sentencia, UTECA ha presentado al Ministerio y a sus representantes opciones t cnica y legalmente viables capaces de enmendar los errores que en su d a, y a su juicio, cometi la Administraci n, y en los que est el nico origen de dicha sentencia, con el fin de mantener las emisiones y evitar una situaci n extrema y de graves consecuencias sociales y econ micas.
Como usted bien sabe, la resoluci n del Tribunal Supremo a la que ahora apelan para ordenar el cese de emisiones tan s lo constata que en la fase final del proceso de transici n de las emisiones anal gicas a la TDT, que deb a culminar con la debida asignaci n a los operadores del espectro necesario para la emisi n de cuatro canales por licencia si hab an cumplido con todos sus compromisos, fue la propia Administraci n quien incurri en una serie de errores y carencias puramente formales. Los operadores cumplieron todas las obligaciones que se les hab an impuesto, pero la Administraci n se retras en reconocerlo hasta despu s de la aprobaci n de la nueva Ley General Audiovisual. Ese es el nico origen de esta dram tica situaci n, que incluso podr a empeorar en el futuro si no se toman las medidas necesarias , afirman desde UTECA.
La propia sentencia en la que se escuda su Ministerio se ala a la Administraci n como nico culpable y reconoce que los damnificados ser n las televisiones, al considerar leg timas sus reclamaciones por da os y perjuicios, ya que cumplieron sus obligaciones durante el proceso de transici n a la TDT.
La ejecutiva de UTECA recuerda a Soria que la simple aprobaci n de un Real Decreto-ley que enmendara dichos errores administrativos y reconociera los compromisos asumidos por el Gobierno en el a o 2005, permitir a mantener sin coste alguno las actuales emisiones. Esta opci n presentada por UTECA se fundamenta en soluciones ya tomadas por su propio Ministerio para otros sectores como el energ tico. Sin embargo, en lugar de solucionar los errores administrativos y hacer cumplir aquello que en su momento el Gobierno acord con los operadores, su Ministerio exige el cese de los canales, con lo que tan s lo generar mayores perjuicios para los operadores de televisi n y para el conjunto de los espa oles.
UTECA y todos sus asociados ya han solicitado el amparo del Tribunal Constitucional, estando dispuestos a emprender todas las acciones legales necesarias para la defensa de sus derechos.
