UTECA discomfort by the judgment of the constitutional about the obligation of 5 per cent to finance Spanish cinema Desde UTECA aseguran que la sentencia del TC no resuelve la impugnaci n presentada por la patronal de las privadas en 2004 contra el Real Decreto 1652/2004 de 9 de julio, y tan s lo da respuesta a la cuesti n de inconstitucionalidad que el Tribunal Supremo plante en 2009. Al comienzo de esta semana, el Tribunal Constitucional hizo p blica su Sentencia en la cuesti n de inconstitucionalidad planteada por el Tribunal Supremo respecto de la obligaci n legal de las televisiones privadas de destinar un 5% de sus ingresos a la financiaci n del cine espa ol y europeo. Dicha sentencia resuelve, despu s de m s de siete a os, que las obligaciones impuestas a las televisiones privadas son acordes con la Constituci n y una simple manifestaci n del poder regulatorio del Estado, que puede fijar esta clase de exigencias de financiaci n de unas empresas a favor de otras.
Desde la Uni n de Televisiones Comerciales en Abierto (UTECA) aseguran que la sentencia del TC no resuelve la impugnaci n presentada por UTECA en 2004 contra el Real Decreto 1652/2004 de 9 de julio, y tan s lo da respuesta a la cuesti n de inconstitucionalidad que el Tribunal Supremo plante en 2009 .
A su juicio, la actual normativa sobre financiaci n del cine por parte de la televisi n que se est respaldando desde el Constitucional, data de 1999 en un contexto radicalmente diferente al actual. Desde entonces, las televisiones privadas han invertido en la financiaci n del cine espa ol m s de 2.000 millones de euros y han impulsado los mayores xitos de cr tica y p blico de los ltimos a os
Durante a os, las millonarias inversiones p blicas de apoyo para el despegue y desarrollo de una casi inexistente industria cinematogr fica independiente', como la ley da en llamar a los productores sin relaci n accionarial con los operadores de televisi n, se han mostrado est riles. Esta circunstancia pone en evidencia la revisi n urgente y necesaria del marco legal que venimos reclamando. Una actualizaci n que permita asumir a las televisiones la totalidad de las atribuciones de un productor, igual ndolas a todos los efectos con los considerados independientes , sostienen desde la patronal de las privadas.
UTECA acata la sentencia del Constitucional, pero comparte el planteamiento del Supremo respecto a la posible inconstitucionalidad de que la libertad de empresa pueda hacerse depender de actos discrecionales del Ejecutivo, y en nombre de ese derecho constitucional, nos preocupa el precedente de que se legitime que un sector privado financie a otro sector privado.
