AMETIC calls for a more efficient model equitable compensation against a new digital canon The employer requests the Government to an effort of analysis and collaboration is made to adopt the model more efficient fair compensation to ensure the protection of intellectual property. A finales de 2011, las sentencias del TJUE y de la Audiencia Nacional de Barcelona, se alaban que el sistema de compensaci n equitativa aplicado a ciertos soportes y aparatos de grabaci n adquiridos por los consumidores no manten a un justo equilibrio al no tener en cuenta el perjuicio efectivamente causado por la copia privada. Por estas razones, el Gobierno espa ol decidi sustituir el modelo de pago por un nuevo modelo de financiaci n consistente en compensar a los titulares de derechos de propiedad intelectual beneficiarios de dicha compensaci n, con cargo a los Presupuestos Generales del Estado por las copias leg timas hechas por los consumidores. Para el c lculo de la compensaci n, la norma en vigor marca que ha de tenerse en cuenta el perjuicio efectivamente causado.

La reciente sentencia del Tribunal Supremo que, aplicando la sentencia del TJUE anula el RD que regula el procedimiento de pago de la compensaci n equitativa con cargo a los PGE, implica que debe realizarse un proceso de adaptaci n del sistema para su adecuaci n a la normativa europea y no necesariamente anularlo y sustituirlo por otro, como exigen las entidades de gesti n. El TJUE indic que el anterior sistema de compensaci n equitativa mediante un canon digital no ten a como base el prejuicio efectivamente causado.

En este sentido, el director general de AMETIC se ala que en cualquier caso, el sistema de compensaci n debe tener en cuenta los criterios establecidos en la Directiva 2001/29/EC, esto es, que la compensaci n sea equitativa, si el perjuicio causado es m nimo, ste no puede dar lugar a una obligaci n de pago y se deben tener en cuenta las medidas tecnol gicas. En definitiva, se debe calcular el perjuicio efectivamente causado .

AMETIC considers in defitiva that a system to ensure that fair compensation corresponding to the authors shall be borne by individuals and not legal entities, such as by modifying the tax systems of VAT or income tax, can be an effective tool no market distortions and allow at the same time, the actual receipt of fair compensation for private copying of holders of intellectual property rights.
