Dispelling the Myths of IP an Software Development

First, not everyone is as honest as you. You might enter into a software development relationship with the best of intentions and be enthusiastic to work with the best code writers in the business. But remember, if there is a way to generate money outside the relationship, some people will take advantage of it. It may be cheaper to outsource development work, but beware of the IP laws governing your relationship or those outsourcers who simply don't care about the laws.

Second, just because you applied for a patent, or have a patent, doesn't mean you were the first to invent. It's possible that someone else can produce evidence that proves otherwise. If you cannot defend against that, you might lose everything that you have worked so hard to produce.

Third, it doesn't matter that you have been developing this technology for years. The patent trolls (a.k.a. Non Practicing Entities) misuse patents as a business strategy. They don't create products themselves; instead they bring lawsuits against those who do.

However, if you haven't taken the necessary steps to secure your IP rights yet, it doesn't mean game over. It means you need to do something about it right now.

If no one has ever suggested the steps to protect your IP, it doesn't mean you're off the hook. You have probably been too focused on developing IP and not thinking about the risk mitigation related to protecting what is yours. But now is the time to learn new strategies and think about prevention of IP theft and improvement of current practices.
