
These will be the keys to the transposition of the European audiovisual directive into Spain La Academia de Televisi n debate con un grupo de expertos sobre el impacto que tendr la transposici n a Espa a de la Directiva de servicios de comunicaci n audiovisual.
the Academia de Televisi n y de las Ciencias y las Artes del Audiovisual organiz en colaboraci n con la Oficina del Parlamento Europeo en Espa a el encuentro Ley Europea de Comunicaci n Audiovisual: Las claves de su transposici n en Espa a. Esta jornada reuni a un grupo de expertos para debatir sobre la transposici n a Espa a de la Directiva de servicios de comunicaci n audiovisual, aprobada el 14 de noviembre de 2018.
La periodista y presidenta de la Academia de Televisi n, Mar a Casado, moder un interesante debate en el que participaron Ib n Garc a del Blanco (S&D), miembro de la Comisi n de Cultura del Parlamento Europeo; M Teresa Arcos, directora general de Telecomunicaciones y de Ordenaci n de los Servicios de Comunicaci n Audiovisual; Miguel Langle, director de Asuntos Regulatorios y Relaciones Institucionales de Atresmedia; Carmen Mar n, jefa de asesor a jur dica de la Federaci n de Organismos de Radio y Televisi n Auton micos (FORTA) y Marisa Castelo, acad mica y presidenta del Instituto Autor. La jornada cont adem s con la intervenci n de numerosos profesionales que pudieron realizar sus preguntas en directo tanto presencialmente como a trav s de Zoom.
El eurodiputado Ib n Garc a del Blanco, que intervino desde Bruselas, asegur que el retraso en la transposici n de la directiva europea en la mayor a de los pa ses se deb a principalmente a la complejidad del sector. Hay muchos intereses y estamos ante una realidad que evoluciona a toda velocidad. Debemos tener una norma lo suficientemente flexible para que no se nos quede obsoleta de la noche a la ma ana . Creo que Espa a va a ser un pa s especialmente ambicioso en la adaptaci n de la directiva y probablemente marque el camino de lo que acabar siendo el futuro en este sector en toda Europa .
For its part, M Teresa Arcos, que respondi a todas las dudas que le plantearon los profesionales, afirm que echa de menos que la directiva haya sido m s ambiciosa en el mundo Internet. Creo que se ha quedado corta . Dado que el contexto digital ha venido para quedarse debemos aceptarlo y aprovecharlo. Hay que buscar todas las posibilidades legales para que la normativa sea justa. No hay que perder de vista que el mundo digital o se regula desde Europa, con mbito de aplicaci n no territorial sino para los operadores que presten servicio en Europa, o estamos perdidos .
Carmen Mar n de FORTA destac la funci n clave de la autorregulaci n de los actores implicados. Que nos permita poder avanzar en el desarrollo de un modelo esencial . Tampoco olvidemos que Espa a es un pa s que tiene una normativa b sica pero tambi n una de desarrollo auton mico que tendr a que ser respetada en el texto definitivo . La globalizaci n traer un efecto muy positivo para la industria espa ola pero somos los medios nacionales y regionales los que venimos sustentando el audiovisual de este pa s y eso no debemos olvidarlo .
Internet le da la vuelta a todo Miguel Langle de Atresmedia destac que el audiovisual ha cambiado, Internet le ha dado la vuelta a todo y deber amos tener unas ciertas reglas para todos. La directiva enfoc bien su objetivo pero se qued corta en las propuestas . Creo que tenemos que continuar en la l nea de lo que pretende el anteproyecto de modernizar la regulaci n para adaptarla a esa realidad, con ese objetivo de que sean las mismas reglas para todos. Y simult neamente, tenemos que ser ambiciosos e innovadores en relaci n al nuevo plan .
Por otro lado, Marisa Castelo, afirm que echaba en falta en la nueva ley sea m s transversal y alguna referencia o gui o a los autores. Lo que no es nuevo es que hay una disociaci n entre la parte de la legislaci n del copyright y la parte de comunicaci n audiovisual. En la primera directiva de servicios de comunicaci n del audiovisual aparec a 3 veces la palabra autor, 3 veces creador, una vez propiedad intelectual y 6 veces contenidos. En el proyecto de ley aparece dos veces la palabra autor vinculada a la definici n de audiovisual europea la obligaci n de financiaci n anticipada de horas audiovisuales. Cero veces la palabra creador, cero veces propiedad intelectual y 122 veces contenidos. Entonces, efectivamente, parece que los contenidos se crean solos .
