
The new General Law on telecommunications will reinforce the sanctioning role of the SSTIS and the CNMC Las multas, una vez publicada la ley en el BOE, para quienes incumplan las resoluciones o requerimientos de la SETSI o la CNMC podr n ir entre los 125 y los 30.000 euros diarios.
El pasado 29 de abril, el Congreso de los Diputados dio luz verde a la Ley General de Telecomunicaciones con el apoyo del PP, PSOE y CIU y el rechazo de PNV e Izquierda Plural.
Uno de los aspectos en los que hace hincapi el nuevo texto es en el refuerzo del poder sancionador de la Secretar a de Estado de Telecomunicaciones y Sociedad de la Informaci n y de la Comisi n Nacional de los Mercados y la Competencia (CNMC), reconoci ndole adem s funciones de asesoramiento y arbitraje.
Las multas, una vez publicada la ley en el BOE, para quienes incumplan las resoluciones o requerimientos de la SETSI o la CNMC podr n ir entre los 125 y los 30.000 euros diarios.
Pero quiz s uno de los puntos que m s llama la atenci n de la ley es la posibilidad de interferir en frecuencias no autorizadas. Seg n apuntan desde el bufete de abogados D ez&Romeo, especializado en derecho tecnol gico y audiovisual, a partir de ahora, el Ministerio podr interferir las frecuencias que no hayan sido autorizadas para su uso. Y s lo autorizan el uso si se gana la preceptiva licencia audiovisual en los concursos p blicos correspondientes .
El procedimiento para de interferir frecuencias est dividido en 4 fases. Inicialmente, se averiguar a la ocupaci n de la frecuencia y se abrir a un periodo de audiencia de diez d as para determinar qui n ocupa la frecuencia, el titular del centro emisor o del inmueble desde el que se emite. Posteriormente, el Ministerio solicitar a el cese de las emisiones en un plazo m ximo de ocho d as. En caso de no interrumpir la se al, la Administraci n interceptar a la emisi n con interferencias (tanto en radio como en televisi n).
A partir de ahora, los inspectores podr n precintar locales, instalaciones o equipos, y no s lo levantar actas que den fe de comprobaciones y mediciones como hasta ahora. La ley establecer que ser obligatorio permitir el acceso a las instalaciones a los operadores que exploten directamente la red (transporte y difusi n de la se al), los que presten servicio de transporte y difusi n aunque no sean operadores, las personas que permitan y den soporte al transporte y difusi n de la se al, los titulares de las fincas o inmuebles en donde se ubique el centro emisor ( equipos o instalaciones) y los administradores y el personal de las empresas involucradas.
Seg n destaca D ez&Romeo, el acceso a las instalaciones se podr hacer por medio de un consentimiento voluntario o mediante autorizaci n judicial (resuelto en el plazo de 3 d as, sin audiencia previa al interesado).
En caso de infracci n los responsables ser n, en caso de no contar con concesi n demanial para el uso del espectro, aquellos que realicen la actividad, cualquiera que disponga de las instalaciones (sino se identifica al responsable) o los titulares de la finca o inmueble desde donde se emita (sino identifica al responsable).
Sanctions
El art culo 79, prev sanciones que podr an llegar hasta los 20 millones de euros, las m s graves, y hasta 50.000 euros, las leves, adem s del precintado de las instalaciones y la incautaci n de equipos.
Adem s, tambi n ser n sancionados, con hasta 60.000 euros, los representantes legales (administradores, ) de las empresas que cometan las sanciones anteriores.
Para D ez&Romeo, con la entrada de la nueva ley se podr acordar el cese urgente de emisiones, sin audiencia previa, antes de que abran expediente sancionador cuando la emisi n perjudique gravemente a servicios de Seguridad P blica, Protecci n Civil, y Emergencias; ponga en peligro la vida humana; o interfiera gravemente a otros servicios o redes de comunicaciones .
