The Court confirms the legality of the contracts signed by Mediapro with several football clubs La sentencia anula el expediente y la sanci n impuesta por la CNMC a Mediapro de m s de 6'5 millones de euros por la firma de contratos con FC Barcelona, Real Madrid, Sevilla FC y Racing.
La Audiencia Nacional ha anulado una sanci n impuesta por la Comisi n Nacional de la Competencia a Mediapro por la firma de contratos de derechos audiovisuales con clubs de f tbol por una duraci n de 4 a os. Despu s de una sentencia precedente del Tribunal Supremo, declarando v lidos los contratos suscritos antes de abril de 2010, la Audiencia Nacional ha anulado el expediente sancionador y la sanci n de 6'5 millones de euros impuesta a Mediapro.
Paralelamente, la Audiencia Nacional ha anulado tambi n las sanciones impuestas a los cuatro clubs. De esta forma FC Barcelona, Real Madrid, Sevilla FC y Racing de Santander no han sufrido ning n perjuicio por la firma de estos contratos.
En noviembre de 2013 la CNMC sancion a Mediapro con m s de 6'5 me de multa por considerar que los contratos de adquisici n de derechos audiovisuales del FC Barcelona, Real Madrid, Sevilla FC y Racing de Santander, con una duraci n de 4 temporadas, eran contrarios a la legislaci n anticompetencia. La CNMC pretend a aplicar a estos contratos una legislaci n aprobada con posterioridad a la firma de los mismos e ignorar la legislaci n europea en este mbito. El grupo audiovisual recurri ante la Audiencia Nacional para que anulara la totalidad del expediente y de la sanci n. En su sentencia, la Audiencia Nacional estima todas las alegaciones presentadas por Mediapro y establece la irregularidad de la sanci n de 6'5 millones impuesta al Grupo.
En la sentencia, la Audiencia Nacional reconoce la legalidad de los contratos firmados por el grupo y confirma que no eran contrarios al Derecho de la competencia y que la multa de 6.573.000 euros fue indebidamente impuesta a Mediapro.
La multa ten a su origen en un expediente sancionador incoado por la CNMC a Mediapro por suscribir con los clubes de f tbol contratos de adquisici n de derechos audiovisuales de la Liga y Copa de S.M. el Rey.
