The CNMC fine with 15 million euros to Mediapro and four football clubs La infracci n, considerada como muy grave se debe a incumplir la resoluci n dictada el 14 de abril de 2010 por el Consejo de la CNC sobre la adquisici n de derechos audiovisuales sobre competiciones de f tbol.
El Consejo de la Comisi n Nacional de los Mercados y de la Competencia (CNMC) ha impuesto multas por 15 millones de euros a Mediapro y varios clubes de f tbol (Real Madrid, FC Barcelona, Sevilla y Racing de Santander) por una infracci n muy grave por incumplir la resoluci n dictada el 14 de abril de 2010 por el Consejo de la CNC sobre la adquisici n de derechos audiovisuales sobre competiciones de f tbol.
La Sala de Competencia considera que la firma con posterioridad al 14 de abril de 2010 de contratos de adquisici n de derechos audiovisuales de Liga y Copa de S.M. El Rey (excepto la final) con una duraci n superior a tres temporadas, constituye un incumplimiento de los dispositivos primero y s ptimo de la Resoluci n del Consejo de la CNC de 14 de abril de 2010, lo que supone una infracci n tipificada como muy grave en el apartado 4 c) del art culo 62 de la Ley 15/2007, de 3 de julio.
Con fecha 14 de abril de 2010, el Consejo de la CNC adopt la Resoluci n sobre el expediente S/0006/07 declarando que los contratos de adquisici n de derechos audiovisuales de Liga y Copa de S.M. El Rey (excepto la final) de clubes de f tbol analizados en dicho expediente con una duraci n superior a tres temporadas, eran acuerdos entre empresas prohibidos por los art culos 1 de la LDC y 101 del TFUE.
Para vigilar el cumplimiento de esta resoluci n, la CNC inici expediente de vigilancia VS/0006/07. En el marco del mismo se dict una resoluci n con fecha de 3 de mayo de 2012 en la que consider que: Mediapro, FC. Barcelona, Racing de Santander y Sevilla hab an incumplido, dado que hab an
firmado, con posterioridad al 14 de abril de 2010, contratos con duraci n superior a tres temporadas. En consecuencia, el Consejo de la CNC inst a la Direcci n de Investigaci n a que incoara un expediente sancionador.
Con fecha 3 de junio se inco el expediente SNC/0029/13 tambi n ampliado al Real Madrid, que ahora ha resuelto el Consejo de la CNMC, tras constatar que las sociedades mencionadas han incurrido en una infracci n muy grave.
En consecuencia el Consejo de la CNMC ha decidido imponer una sanci n de 6,573 millones de euros a Mediaproducci n ; 3,9 millones de euros al Real Madrid Club de F tbol; 3,6 millones de euros al F tbol Club Barcelona; 900.000 euros al Sevilla F tbol Club SAD; y 30.000 euros al Real R cing Club de Santander SAD.
Para el c lculo de la multa, la CNMC ha tenido en cuenta los contratos firmados por cada parte afectada que contravienen la Resoluci n de la CNC de 14 de abril de 2010 y el importe por temporada que suponen estos contratos (que, como se ha visto, sobrepasan en una temporada el m ximo de las tres temporadas establecido en la mencionada Resoluci n), as como el volumen de negocios de las empresas objeto de las multas.
