
Congress gives the green light to the new General Law on telecommunications La nueva ley fomentar las inversiones en redes ultrarr pidas, establece la unidad de mercado e intentar mejorar la protecci n al ciudadano.
El Pleno del Congreso de los Diputados ha aprobado este martes la Ley General de Telecomunicaciones impulsada por el departamento del ministro de Industria, Energ a y Turismo, Jose Manuel Soria, con los votos a favor de PP, PSOE, CiU y PNV. En el Senado se hab a contado con el apoyo adicional de Entesa.
La aprobaci n de esta ley por el 95% de los votos en cada una de las C maras, es una muestra del amplio consenso obtenido entre los diferentes grupos parlamentarios, tras un gran esfuerzo realizado por parte de todos los grupos y de la clara vocaci n de este Gobierno en la b squeda de acuerdos, como ya se hab a anunciado en su presentaci n como proyecto de ley en el Congreso.
La nueva Ley General de Telecomunicaciones es una ley necesaria, oportuna, reformista y ambiciosa en un momento en el que el sector de las telecomunicaciones vive una renovaci n tecnol gica importante.
Con esta ley se sientan las bases para que los ciudadanos disfruten de las ventajas y servicios de la alta velocidad de acceso a internet, tanto desde su hogar como en movilidad.
La nueva Ley se configura como la clave que sustenta el r gimen jur dico de las telecomunicaciones y es un instrumento de primer orden para llevar a cabo reformas estructurales en uno de los sectores llamados a ser palanca de la recuperaci n de Espa a.
La Ley General de Telecomunicaciones persigue como objetivos principales la cohesi n social y territorial en el mbito de las telecomunicaciones, la eficiencia en los despliegues mediante la adopci n de medidas que ayuden a los operadores a desplegar sus redes con mayor facilidad y as poder realizar las inversiones que la innovaci n tecnol gica demanda y que es una caracter stica de este sector. Adem s, refuerza la unidad de mercado mediante el dise o de nuevos mecanismos de colaboraci n entre el Estado y las restantes Administraciones P blicas, que faciliten la adopci n de acuerdos y el ejercicio leg timo de las competencias de las distintas Administraciones.
Con la consecuci n de estos objetivos se pretenden alcanzar los fines ltimos que persigue la nueva Ley General: disponer de redes y servicios m s innovadores, m s adaptados a las necesidades de los ciudadanos, de mayor calidad y a unos precios cada vez m s asequibles, que contribuyan al crecimiento y a la recuperaci n econ mica, as como, a la creaci n de empleo.
Mejoras introducidas en la tramitaci n parlamentaria
Durante la tramitaci n parlamentaria se han incorporado en total 179 enmiendas. En el Congreso, tanto el grupo parlamentario socialista como CiU trabajaron conjuntamente con el Grupo Popular para mejorar la Ley. En el Senado se unieron al consenso Entesa y, finalmente, en la votaci n de hoy el PNV se ha unido tambi n.
En el Congreso se aprobaron 53 enmiendas en sus propios t rminos y 92 m s de los diferentes grupos a trav s de textos transaccionales. En el Senado se han aprobado 34 enmiendas (5 transaccionales).
Entre otras enmiendas, se ha previsto garantizar la unidad de mercado en el sector de las telecomunicaciones y se facilita por el conjunto de Administraciones P blicas el que los operadores puedan desplegar sus redes y realizar inversiones.
Al mismo tiempo, se apuesta por reforzar y clarificar las competencias de la CNMC, por ejemplo, en materia sancionadora, en la asignaci n de la competencia residual y en el reconocimiento de manera expresa, de sus funciones de asesoramiento o arbitraje, entre otras.
El texto legal prev tambi n medidas para reducir la brecha digital y para universalizar la banda ancha. Tambi n se ha introducido una disposici n adicional que persigue impulsar la pol tica industrial del sector TIC y la innovaci n en este mbito.
