Spain's National Market and Communication Commission has fined broadcaster Telefonica 1.5 million for breaching the terms of its takeover of pay-TV platform DTS.

The regulator found that Telefonica failed to provide wholesale access to the premium football content on the channels it acquired at a guaranteed minimum rate.

The CNMC said that Telefonica wrongly calculated how many subscribers it had when it provided the minimum guaranteed cost of its Movistar Partidazo channel in July 2016. The number it calculated was lower than it should have been, resulting in higher costs for operators who were interested in contracting the channel, such as Vodafone, Orange and Telecable.

Telefonica has two months to file a contentious-administrative appeal before the National High Court.
