UTECA takes positions against the project of the new national technical Plan for DTT El proyecto de Real Decreto se limita, seg n UTECA, a establecer instrumentos de actuaciones, sin que previamente exista un marco legal estable sobre el que llevarlas a cabo.
En respuesta al proyecto de Real Decreto presentado por el Ministerio de Industria, Energ a y Turismo al CATSI (Consejo Asesor de Telecomunciaciones y de la Sociedad de la Informaci n), UTECA ha hecho p blico un comunicado el que asegura que el texto se limita a establecer instrumentos de actuaciones, sin que previamente exista un marco legal estable sobre el que llevarlas a cabo, ya que no est aclarada de forma definitiva la situaci n de los actuales 15 canales nacionales de TDT. El proyecto parece intentar consolidar lo que consideramos un error may sculo de la reciente p rdida de canales, anticipando nuevas adjudicaciones injustificadas sin precisar sus condiciones .
La patronal de la televisi n privada en Espa a recuerda que existen varios recursos ante el Tribunal Supremo que cuestionan la existencia de 8 canales privados de TDT, adicionales a los 9 cerrados en mayo de 2014.
Por otro lado, desde UTECA denuncian que el borrador se haya llevado a cabo de manera unilateral por la SETSI sin ninguna previa consulta o participaci n de UTECA o sus asociados, principales afectados por el proceso de liberaci n del dividendo digital, asignando m ltiples concretos sin conocerse el racional subyacente y sin haberse posibilitado que las televisiones hicieran una propuesta de consenso entre ellas a la b squeda de reducir molestias a los ciudadanos en las labores de resintonizaci n.
La asignaci n de capacidad de emisi n propuesta en el borrador continua, una vez m s, tratando de forma discriminatoria a las televisiones privadas frente a TVE, a la que destina un ancho de banda mucho mayor que a las privadas, cuando estas operan un n mero igual o superior de canales que, adem s, son las televisiones de referencia del p blico espa ol desde hace a os , afirman desde UTECA.
En cuanto al desarrollo de la alta definici n, UTECA considera una paradoja que, pese a que el Ministerio de Industria, Energ a y Turismo ha manifiestado su compromiso con HD, escatime la asignaci n de espectro a las televisiones privadas, condicionando la apuesta de estas por la alta definici n al dejar limitado el n mero de los canales en alta definici n que ya se pueden ofrecer. Todo ello mientras deja tanto espectro sin asignar .
Las privadas entienden que el proyecto de Real Decreto presentado es inusitadamente oscuro respecto a las potenciales nuevas adjudicaciones del espectro no asignado, al se alar que se otorgar n mediante concursos, pero sin ofrecer ning n dato sobre los t rminos y condiciones de dichos concursos ni calendarios ni plazos de las licitaciones .
Por ltimo, UTECA se ala que la propuesta del Plan T cnico tampoco incluye ninguna menci n expresa sobre el tema capital de la financiaci n de los costes de reubicaci n de los canales y, en definitiva, la reordenaci n del espectro digital, a pesar de que este aspecto est regulado en el vigente art culo 51, p rrafo segundo, de la Ley de Econom a Sostenible, que prescribe que Los costes derivados de la reorganizaci n del espectro radioel ctrico que es necesario realizar para liberar la banda de frecuencias 790 a 862Mhz., ser n sufragados por la Administraci n con los ingresos obtenidos en las licitaciones p blicas que se convoquen para asignar espectro radioel ctrico . Al amparo de esta ley, a juicio de UTECA, el coste de esta transici n no puede recaer ni en los operadores ni en los ciudadanos .
